1. General Information
These Terms and Conditions apply to purchases made through the website touchseen.eu, owned by SIA BRUNERA (Reg. No. 40203399392).
By placing an order, the Customer confirms that they have read, understood, and agree to these Terms and Conditions.
2. Distance Contract
Placing an order on touchseen.eu constitutes a distance contract within the meaning of the laws and regulations of the Republic of Latvia.
The contract enters into force at the moment the Customer places the order and receives an order confirmation email.
3. Ordering Process
3.1. The Customer selects a product and adds it to the shopping cart.
3.2. Before payment, the Customer must provide accurate information (name, address, phone number, email).
3.3. The order is considered accepted when the Customer confirms payment.
4. Prices, Payment, and Settlement Terms
4.1. All prices are shown inclusive of VAT.
4.2. Payment can be made via bank transfer, payment card processing, or other payment methods available at the time of ordering.
4.3. The order will be processed after payment has been received.
5. Delivery Terms
5.1. Delivery is made to the address specified by the Customer.
5.2. The delivery method and costs are indicated before payment is completed.
5.3. TouchSeen shall not be liable for delays caused by the delivery service provider or by incomplete or incorrect information provided by the Customer.
6. Right of Withdrawal and Returns
6.1. The Customer has the right to withdraw from the purchase within 14 days in accordance with the Distance Contract Law.
6.2. The product must be unused, in its original packaging, and include all accessories.
6.3. Exception: If the product has been activated or used for safety monitoring purposes (e.g., a light sensor device), and its inspection affects functionality, TouchSeen reserves the right to reduce the refundable amount accordingly.
6.4. Return costs are borne by the Customer, except in cases where a defective or incorrect product has been delivered.
7. Warranty and Safe Use
7.1. The product is covered by a 24-month warranty against physical defects.
7.2. The warranty does not cover damage resulting from improper use or installation.
7.3. The use of the device for safety or senior monitoring purposes does not provide medical or emergency assistance — it is an informational device only.
8. Processing of Personal Data
8.1. Personal data is processed in accordance with the Privacy Policy and applicable data protection legislation (including GDPR).
8.2. Customer data is used to:
- process orders, deliveries, and payments;
- create and maintain a Customer profile on the website or application (if available);
- ensure device compatibility with the application and proper data linkage;
- provide technical support, warranty service, and communication related to the order or device operation;
- inform the Customer about device testing progress, improvements, or recommendations;
- enable contract extension and subscription renewal after the initial period.
8.3. Data may be used for commercial communications (e.g., updates, subscription reminders) only with the Customer’s prior consent, which may be given during checkout or account registration.
8.4. The Customer has the right at any time to withdraw consent, request deletion or correction of data, or restrict processing in accordance with applicable laws.
9. Customer Obligations
9.1. Provide truthful and accurate information during ordering and account creation.
9.2. Pay for the order and any subsequent subscription in a timely manner (if applicable).
9.3. Ensure the possibility of product delivery and, if necessary, communication for device installation or testing purposes.
9.4. Use the device in accordance with the user manual and not for purposes other than intended.
9.5. Not disclose application access credentials or device connection details to third parties.
10. Dispute Resolution
Disputes shall be resolved through mutual negotiations. If no agreement is reached, disputes shall be resolved in accordance with the laws and regulations of the Republic of Latvia.

12. Final Provisions
